The Reaming of Francis Blake of PS 157 District 7

Here it is in all its glory. The decision against Francis Blake by the arbitrator Alan Berg. DR Mychael Willon is mentioned as is Donald Conyers as two upstanding human beings. The last two pages include the reversal of Francis' penalty to a five thousand dollar fine and two months suspension. FYI, Francis is appealing the decision.

Oh one more thing. I redacted Francis' file number and SS #. However, other sentences in the first few pages will look redacted but they are not. I used too dark a highlighter on my copy and it came out too dark. My apologies.

  1. 5,000 dollar award (fine) and a two month suspension? Seems somewhat excessive to me. However, it did seem that the Arbitrator did find the person guilty of most of the counts.

  2. I see that the Arbitrator modified the award to 5,000 dollars and two months salary which is about 12,000 dollars. At least the teacher will still have health benefits and not lose pension credits.

  3. This is a very stiff penalty? Is this arbitrator just makin' it up as he goes along? Why not 20,000 and three months pay? What does the fine have to do with pedagogical incompetence? I know arbitrators want to ingratiate themselves with DOE but this is over the top!!

    And Chaz...your point on the pension credits is noted but check the math as he now has to pay the pre-tax amount for the two months pay...not the amount he actually receives. If he was suspended without pay he would only be losing the amount he normally receives in his pay check for two months !!!!(plus, of course, the arbitrary 5K.)

  4. While the arbitrator cites 'misconduct his final lines as justification for his excessive fines, there is really not misconduct here besides an isolated sleeping incident. No insubordination, etc. More like pedagogical judgment.

  5. I'm trying to find Duran's lying. Is it redacted? Berg HEAPS praise on her!
    Does Duran say how she got the job at PS 157?
    Who does Duran say she who she eats lunch with? There's usually more to these things than meets the eye.
    She talked about this...with the people she eats lunch
    with...made the Decision well in Advance of this Hearing...
    Overzealous about going downtown...and doin' the dirty work...that's her...
