DC 37 Settled. What's Next for UFT Members?

 It seems that DC 37 has set the bargain for us all. Thank you DC 37! But is it all for naught?

As per James Eterno's blog and The City DC 37 agreed raises of:

May 26, 2021: 3.00% 

May 26, 2022: 3.00% 

May 26, 2023: 3.00% 

May 26, 2024: 3.00% 

May 26, 2025: 3.25% 

May 26, 2026: 0%

As well as a $3,000 dollar signing bonus. Nice pattern. Are DC 37 members getting retro, and if so, will it be in one lump sum or spread out over 20 years? 

Several things have crossed my mind. Yes, inflation is high, but it is on its way down. So for now, at least for me, I have a wait and see. Of course we have Mike Mulgrew has our leader so he might think us getting less would be a great deal. 

As for the bonus, hey I am all for a bonus. But not for $3k. I want at least double. But Mulgrew is our leader. We're screwed. 

But the devil is in the details. We still don't know about healthcare. That is the most important part. I'm still of the mind that we have it pretty good as far as healthcare in comparison to our counterparts in the rest of the state. But I saw also saw this on James' blog and it is somewhat disconcerting. 

The unions owe the city $1 billion? Other than voting Mulgrew out what can be done? I have said it before put the burden on new and newer teachers. Also, combine all the welfare plans into one. Yes, the number of patronage jobs will be affected but I'm sure there are savings to be found. Heck, even Arthur put this idea about combining the Welfare Funds together...

I don't believe a consolidated Welfare Fund would be any less efficient than the one we already have. It would surely be a hell of an improvement over screwing our retirees.

But, we have Mike Mulgrew leading us. From behind. 

My predictions for the new contract?

We'll get 2 percent raise per year for the first four years, and then 2.1 percent for the fifth year. 

Instead of a $3k bonus like DC 37 received we will get a coupons worth $19.99 in savings to Applebee's that will only be valid on Mondays and Tuesdays.

We'll get retro but the payouts will be stretched through 2031. The rules will be the same but if you turn 65 before the retro is fully paid you are out of luck. 

Teachers will no longer receive letters to file. Instead teachers will be summarily executed. However, the families of the executed teachers shall receive full benefits. The union will say, "Hey, at least your next of kin will be getting paid."

DC 37 has no settled. The proverbial ball is now in Mulgrew's court to totally fuck it up.

Mulgrew's Conniption. Now How do we Battle Apathy and Ignorance?

I'm supposed to be with my high school friends right now. Right now I am in a hotel room in Schenectady spending the weekend at the Rivers Casino. But I was checking the blogs and came across James Eterno's ICE blog. I was reading about the disaster Mulgrew had at Wednesday's Delegate Assembly meeting and
decided to take the laptop out. 

Since I am no longer a delegate, I now have to hear about things through the blogs or second hand. From what I have read it is about time something like this happened. 

Back in 2019 I wrote how to make the DA more transparent and more inclusive. Two ideas that I had were to allow live streaming of the DA to all members. There are many platforms available and at not really much cost. Well, that seemed to have happened Wednesday when someone, somewhere transmitted the live DA to opponents in front of 52 Broadway. Good. About time. But the dirty little secret is; this has been happening for some time, especially the last 18 months when the DA's were phone based.

Oh yeah. The UFT will say, "Anyone can watch." Sure, anyone can. If they schlep down to 52 Broadway and then whisked off to a cold room with a live feed off of a shit poor monitor. The time is now to make all DAs available on the UFT website, Facebook, Twitter, and wherever else possible. Want us to sign in with logins we use to go on UFT website, fine. There are methods to keep non members out. 

As for the voting? I love the voting system that is used by phone. It's awesome. True democracy. The ability for delegates to not fear reprisals. However, one should wonder if the union knows how someone  voted by phone number. 

It's time for the delegate assembly to enter the 21st century. The UFT has an app, let delegates vote by using the UFT app. I can get a high school student to help the UFT add such abilities. In fact, the same high school student can also help the UFT add any possible bandwidth it might need.  

Is this damaging to Unity in the long run? No, not really. It might change some people's minds. Those who stay on top of what is going on with the UFT. Delegates, bloggers, people who read the blogs, other activists, but that is not enough to cause a major disruption. The people who already give a shit are out there. Be they on Facebook, Twitter, or some other social media. 

How do you reach the apathetic or the ignorant? No one has come up with the answer. I think I have and I tried. I tried in 2016 but was brushed aside with "we have memes." The memes being read by the same people that already share the same views. Nothing is better than campaigning in an echo chamber. 

A few weeks ago in my school we had an election for a vacant delegate position. I threw my hat in at the last minute. Someone ran against me, a teacher that has been at the school for several years. I have been at the school since September. I lost. I got six votes. The other person got 13 votes. Twenty people voted in a school with almost 100 UFT members. No one cared nor did anyone really know what a delegate does or why a delegate is important. Why? Many, many young and new teachers. Will these teachers be voting come the spring when the get their ballots at home? Will they take the time to not only fill out the ballots but to mail the ballots as well? 

How to get to the apathetic? They need to know there is a choice and a reason to vote. They need to be identified. Think of multi level marketing (This is the only idea I am sharing). Each person speaks to ten people. Talk to their needs. Listen to their needs. MAKE THE MESSAGES to their needs. This is why the Democrats are losing the rural areas. They don't talk to nor do they listen to the needs of other voters outside of their own bubble. This has been the problem for the last several elections by some. Some refuse to get out of their comfort zone.

There must be a recognizable name at the head of the ticket. A name that is known and has experience advocating for the rank and file as well has had run in previous elections. A veteran teacher. A teacher that has been through the ups and downs of the DOE. A teacher that has been on national TV, not once, but several times. 

Unity will be very, very hard to beat. But to even put a sizeable dent will take more than just leafleting schools. It will take rolling up the sleeves and thinking outside the box. But sadly, I am seeing some want to cut off their noses to spite their faces and refuse to play with others. Those others who know how to fight. Know how to roll up their sleeves. And those that really and truly want to win.

Retirees Being Swindled By UFT With Medicare Advantage Rollout

 I haven't really been paying too much attention to the change over, as well as the fight over, the switch for retirees from Medicare to the new Medicare Advantage. I've basically reduced myself to reading both James Eterno's blog and Norm Scott's blog for great information. I'm also getting some information from my step-mom who is a retired CSA member. She's not craxy about my proclivity for rabble rousing so she doesn't share much with me. 

Heck, this is going to effect me in 6 1/2 years, and I should pay more attention. From what I have read I don't like the co-payments, the referrals, and more importantly the "Trust us, it's going to be great" rhetoric coming from Mulgrew. But one thing really is bugging me.

What's the rush to sign everyone up by October 31? 

To the best of my recollection, the deal was done around July, maybe a little sooner (Please correct me if I'm incorrect). As far as I can tell, retirees are going into this blindly. They don't know which doctors, which hospitals or any other providers will be available. All they get is: "Trust us, it's going to be great."

Which brings me to two personal stories. In 1995 when I started with the DOE, I signed up with Physician Health Services. The only reason I signed up for PHS was all of our doctors were on it. I paid for it, unlike GHI which then and now is free. But eventually GHI got more of our doctors on it and we went to GHI. The key was doctors, a wide selection of doctors, and hospitals and providers.

Just recently I was looking at changing out from our top notch, world renowned UFT dental plan (SARCASM). I wanted to switch to the DENTCARE HMO. I researched it and found that not only are there very few providers, but the customer service sucks as well. It wasn't worth it. 

So, back to the Medicare Advantage. Retirees are walking blind into higgedly piggdly of a plan. There is not a list of doctors and providers. No one knows if their doctors that they have had a relationship with for years will be on this plan. No one knows if God forbid they are in treatment for a chronic condition they will be able to continue receiving the same treatment. This is where the UFT and other unions screwed up.

Why the rush? If as Mulgrew claims, "Trust us, it's going to be great," why not how all how great it is. This implementation should have started with NEXT October of 2022 for the sign ins or sign outs. This way, an educated choice of knowing ALL the providers will give those a basis to make a choice.

And beforehand why not have a true year to test out the new Medicare Advantage program. Incentivize retirees to sign up now in October 2021 and this way the kinks can and will be worked out. This way when others start opting in or out in October 2022 not one retiree will be going into this blind. 

Let's not forget the retirees who live where there re a dearth of providers. What of the retiree who has retired to North Dakota? Or the Alaska? What about where there are plenty of providers such as Florida but very few providers will be on the Medicare Advantage. Would the retiree who lives in Tampa have to schlep across the state to West Palm Beach for a prostate exam?

Something smells fishy here. This rush to get everyone in just leaves a bad taste in my mouth. Yes, there are plenty of retirees who can afford the out of pocket expense of paying into regular Medicare, but there are plenty of others who can't. And we are only stronger as people, as teachers, as retirees, and as UFT members as our weakest link. These are the people we should fight for. 

The UFT rammed this through. This should have been better explained and had much more input from retirees. This change should have been voted on as a whole by the union. Too often this happens. That some change is just shoved down our throats which the very few decide for several hundred thousand. 

Too bad chapter elections have come and gone. It's time to vote out the leadership of the retiree's chapter. Perhaps a recall is due?

When a UFT Victory is Not Really a Victory

 We are hearing the word "victory" bandied about quite a bit, in the last several days since Friday's arbitration hearing. The UFT is claiming victory for defending our earned retro pay that is owed us from 2009-2014. Yes, I am happy that we will be getting it. Though not quite as happy receiving two payments as opposed to one. This is a victory for the city and a loss for the UFT and the rank and file. De Blasio knew exactly what he was doing. 

It was no coincidence that DeB notified the city a week before our we would have received our retro. DeB and the city knew over the summer they were going to try to pull this off. But if they announced it in the summer there would have been talks first. Talks drag on. That would not have benefited the city. 

What to do? Take advantage of the clause in the MOA that anything concerning the retro would go straight to arbitration. Yes, the rank and file should be grateful that the UFT made the clause was part of the MOA. But guess what? That clause was taken advantage of by the city as well. In fact they were hoping for it to be invoked. They got their wish.

Why did the city wish to go to arbitration? Think of this old saying; "You never know how a jury will rule." In this case, an arbitrator. The city had nothing to lose, the UFT everything to lose. There's already a doo-doo storm (The Crack Team had informed me that in the last blog post there were too many naughty words) over the retro being split in two payments. Imagine what would happen if the arbitrator found for the city? 

pyrrhic the UFT was forced to negotiate from a defensive posture. It had no choice but, and for lack of a better word, to cave. James Eterno made a good point on his blog that the arbitrator did not decide this. But rather,  the case was settled between the parties. It was a consent degree. The city had Mulgrew by his proverbial goodies (Again, no naughty words). 

I do disagree slightly with James about that if we didn't get our entire payment in full we should have gone right to court. Again, using the old adage, there is no assurance how a judge would rule. But that's a chance we would have had to take. 

The city wanted something in return, and they got it. After my initial shock on hearing the news Thursday night I figured that out. But what did the city want? My guess was that we would have to furlough 5 days. I was wrong. But no one gets something for nothing. And it is always the UFT giving something for nothing. 

This stunt the city pulled never would have been attempted with the cops, the firefighters, sanitation workers, corrections officers, or any other city union. Again and again the teachers and the UFT are used to go #2 on (again, no naughty words). 

There are many teacher's that adjusted their TDA's and now are screwed. There are many teachers that were counting on this check to catch up on bills and now are screwed. But again, the perception is WE DON'T MATTER. 

This is nothing but a pyrrhic win by the UFT and they are backslapping themselves whilst sipping champagne. This was a gimme putt an inch from the hole.  

What should be done? Openness to begin with. Make public the transcript between the parties and the arbitrator. Put it up on the UFT website. We should demand it. Show us proof there was some negotiations. Show us proof what the UFT had to offer and/or say. Same with the city. These time demand clear candor on the part of the UFT. It is time. 

And the UFT must answer these questions post haste: 1)What is the status of the upcoming per session retro pay and, 2)what of those that are in my situation that will still be owed a payment in October 2021?

We Here at SBSB Welcome the DSA as Our New Masters and Overlords

About 10 days ago, James Eterno on the ICE blog shared a story from Politico how the Democratic Socialists of America is planning to infiltrate and then take over the unions of New York City with the UFT seen as the ripest to fall first.

Some highlights from the article include (with a few comments by myself in red)...
The New York City branch of the Democratic Socialists of America presented its members with a strategy last year to gain entry into some of the city’s most powerful labor organizations and ensure they are adhering to the “militant” principles that the group felt had been diluted over time.  

...members approved zeroing in on six of those labor groups 

The organization also identifies ways outsiders can access jobs that would allow them entree into the labor groups.

Another target is the United Federation of Teachers, a nearly 200,000-member union representing teachers, social workers, secretaries and other school employees.   

UFT is the largest local of one of the largest unions in the country. It has the potential to be extremely influential in electoral politics,” the group wrote. “It is extremely internally undemocratic, but there is a reform caucus, MORE, which has many active DSA members.” MORE democratic? Surely, they jest.
“With more DSA teachers, we could bolster and significantly support the internal movement for democracy and militant organizing within the union but it will likely take years to reform the UFT,” Too fucking funny. 
Look, I can see what is coming down real soon. The DSA is for real. They mean business. It won't be long before we are all singing the DSA's praises and lavishing gifts, as well as some form of human sacrifices, upon their leaders. Where do I sign up? 
I've seen the videos. These are people that shouldn't be underestimated nor fucked with. 
After discussing with The Crack Team at an emergency SBSB meeting, and wishing to appeal in a special ass kissery manner to our soon to be new masters and overlords, we present video of a DSA conference.

But seriously. First off, I swear this is nearly what a MORE meeting was like. Secondly, this is the future of the labor movement? Where are this children's parents when you need them? My 18 year old son considers himself progressive. He's going to a somewhat progressive college in one of the most progressive cities in New Yok State. He has said he has no time for people who need safe spaces, trigger warnings or whine about micro aggression. 
DSA wants to take over NYC unions? Show some balls. Start with the PBA, the Firefighters union, Sanitation union, Teamsters, Corrections union, and the union for the TWU. Succeed without getting wedgies, swirlies, and Indian Native American burns then I'll listen. Until then, go away.

UFT President Mulgrew Gets $8,250 in US Open Tickets for Free

Dang. Our venerable UFT Presidenté Mike Mulgrew was in the Post yesterday. It seems that he has accepted...
...two tickets worth a total of $1,250 in 2012, and two tickets worth $1,300 in 2013. In 2014, he received $2,700 in tickets. In 2015 and 2016, he got tickets worth $1,500 each year.
That's a total of (Hang on The Crack Team is crunching the numbers.) $8,250. Who did he get these tickets from? According to the New York Post these tickets were obtained through.
a that firm represents the UFT and other city unions in litigation. In 2017, it collected $2.9 million in legal fees from the UFT...Stroock & Stroock & Lavan, the firm that collected $15.5 million in fees from the UFT in that time.

Yes, I get it. The UFT needs a law firm to do whatever it does. Virginia LoPreto, while probably less costly, can't do everything herself. I also understand that a business wishes to reward clients and throws them tickets. My dad had a business for years, and he would get tickets for his clients as well. It's the price of doing business.

But running a union, especially the UFT where time and time again it's leaders come across as tone deaf to the masses this is bad optics. James Eterno as quoted on the Post article as saying...
“It doesn’t pass the smell test. Your average teacher isn’t getting these kinds of perks — and nor should our union leaders.”
No, it doesn't James. Yes, Mulgrew can do this, but should he? That is the bigger question.

Just as out to lunch is Stoock partner Charles Moerdler who said he was unaware of the ticket exchange and went on to say...
“We have season tickets to a whole variety of sporting events, and we give them to clients who ask for them.”
So Uncle Mike asked for US Open tickets? Why? I used to the men's finals every year when  when I was a kid. I had to sit through a 5 1/2 hour match between Bjorn Borg and John McEnroe in 1980 (I think).

Sorry Norm, no raffle for winter coats. Technically, myself and every single UFT member are clients of Stroock. I am putting my request for tickets to Mr Moerdler. Other UFT members should do the same. Let's see if he comes through.

In order of preference this is my wish list I will present (I will accept two tickets please.).

Super Bowl LIII (I will find my own way to Atlanta.)

Opening Night (Can you believe? Game is scheduled at 6:35!) for Yankees April 1. If game is moved to the afternoon please disregard. And no substituting with Opening Day Mets tickets. I only watch Major League baseball. 

Giants vs Cowboys last game of 2018 and possible Eli's last game as a Giant. 

Any home Rangers game or a Devil's game. 

The 2020 US Open (golf) at Winged Foot. Final round. Mickelson might finally atone for his 2006 disaster.

2019 Masters.

Knicks or Nets home game. 

Islanders, only at the Coliseum. 

Oh, if Rush somehow starts touring again, Rush moves to top of the line.

If Mr Moerdler is kind enough to give me four tickets, I will take two UFT along with myself and my son. Beers on me. 

With Janus looming over the UFT and all public sector unions like the sword of Damocles the optics of our union leaders must improve.

Pay Dues. Don't Freeload.

The Westchester Journal News has reported that New York State has stopped collecting
agency fees from 31,000 state workers. As far as I am concerned that is 31k freeloaders and rats.

I am getting tired of this whining from UFT "members" who are threatening to withhold dues in light of Janus. Yes, as I ahve said in the past, I empathize with them. But a dysfunctional union is better than no union or not being in a union.

I have been reading a lot of the comments on James Eterno's blog. Yes, the grievances and feelings are real. But the one question I brought up and could not be answered to the complainers is, "What have you ever done for 'the cause'"? The question has been met with silence. Instead of cursing the darkness light a god damn candle.

I ask those that are thinking of freeloading that are reading this, what have you done? Where have you been? And please, anonymous comments on blogs don't count.

Even under the best of circumstances if the UFT was strong and proactive there would be people complaining and kvetching. Nothing is perfect. Too many are looking for a perfect fit on an off the rack world.

Yeah, our working conditions and the way we have been treated pretty much sucks. But we make more than most teachers in the country, let alone New York State. We have solid pensions awaiting us. We have rights that are bargained for. And, we have great health benefits.

Yeah, Mulgrew got stupid again about saying health benefits can be bargained. Would you rather have no health benefits? Crappier health benefits? A friend of mine that teaches in Armonk NY told me that he has a family deductible of about $6k on his health plan and pays into it 10% (or a little less) or so of his pay. If you have GHI you pay $0 and with the out of network rider (which I have) $16 a month.

I have been without insurance and on insurance. Guess which I prefer? Thirty years ago I dislocated my right shoulder (I am a lefty). It was popped back in never saw a doctor because I had no way to pay for it. I have developed horrible arthritis, I have bone grinding against bone, I'm in pain, can't golf, and I will need a shoulder replacement eventually.

In January my wife had almost her entire back fused. We saw the hospital bill. It cames to about $550k, with about $200k for the hardware in her back. Maybe another $95k for the bed. We owe $200.

This is what you can give up if you fail to join the union and other things as well. Under law freeloaders are covered by the CBA. Well, what happens if the next CBA there are provisions for freeloaders to be own their own? Too bad.

Remember, how the UFT got the family leave (Yes, it's not parental, stop bitching.). And something that was just shared with me. Family leave was negotiated outside of the contract so we would not have to do a quid pro quo. Yeah, sometimes the UFT gets it right.

But the worst thing, aside from being a freeloader, for not paying dues is that you will hurt each and every member staying in the union (I've been to a union meeting already. The anger at the freeloaders is just beginning), in negotiations, in solidarity, in advancing our needs, and more importantly, the needs and wants of the communities we teach in.

Being angry and frustrated is fine. Acting out on being angry and frustrated impulsively and for spite will hurt others and worse, yourself.

Petition to Repeal NYS Teacher Evaluation Laws 3012-c and 3012-d

We must return teacher evaluation to local districts free from state mandates by repealing New York State Education Laws 3012-c and 3012-d.

  • Evaluating teachers based on student results on tests and other student assessments that were never designed to rate educators is neither a scientifically or educationally sound way to be used for a Measure of Student Learning portion of a teacher's rating.
  •  The Measure of Teacher Practice portion of teacher evaluations is subjective and highly unfair, particularly in NYC where the Danielson Framework has been used not to help teachers grow as professionals but as a weapon to frighten teachers into teaching to score points on arbitrary rubrics in multiple unnecessary classroom observations.
Why we are starting this petition?
 
The teacher evaluation system in NYS is broken beyond repair. NYS passed a flawed evaluation system into law in order to receive federal Race to the Top funds. However, the current version of the federal Every Student Succeeds Act no longer requires states to rate teachers in part based on student test results to receive federal funds.  Rating teachers on student exam scores is not recommended by the American Statistical Association as it is not a reliable way to measure teacher performance yet in New York we only have a moratorium on using standardized tests to rate certain teachers. Teachers are still rated on tests and other assessments that were never designed to rate teachers. The Measures of Student Learning portion of teacher ratings is highly unreliable. Many call it "junk science."

NYS ELA tests cannot measure student progress under any particular standard.From a statistical standpoint, a handful of questions per standard is not a statistically sound measure of a student’s mastery of that standard.  Additionally, test passages that are on, above or even slightly below grade level cannot measure the progress of a struggling reader who enters a class two to four years below grade level. These tests cannot measure the progress of newcomers to our country who are learning English as a new language.  It takes many years for newcomers to master the nuances of the English language.  In effect, students such as these described above can make more than a year’s worth of progress and yet still not show progress on the NYS ELA due to the text complexity of all test passages.
The Measure of Teacher Practice portion of teacher ratings in New York City is based on the Danielson Framework whose creator, Charlotte Danielson, said this about teacher evaluation in Education Week:

"There is ...little consensus on how the profession should define "good teaching." Many state systems require districts to evaluate teachers on the learning gains of their students. These policies have been implemented despite the objections from many in the measurement community regarding the limitations of available tests and the challenge of accurately attributing student learning to individual teachers.
"Even when personnel policies define good teaching as the teaching practices that promote student learning and are validated by independent research, few jurisdictions require their evaluators to actually demonstrate skill in making accurate judgments. But since evaluators must assign a score, teaching is distilled to numbers, ratings, and rankings, conveying a reductive nature to educators' professional worth and undermining their overall confidence in the system.

"I'm deeply troubled by the transformation of teaching from a complex profession requiring nuanced judgment to the performance of certain behaviors that can be ticked off on a checklist. In fact, I (and many others in the academic and policy communities) believe it's time for a major rethinking of how we structure teacher evaluation to ensure that teachers, as professionals, can benefit from numerous opportunities to continually refine their craft."

The Danielson Rubric describes an ideal classroom setting and was never intended to be used as an evaluative tool against teachers. Examples: A rubric that rates a teacher "developing" when he/she "attempts to respond to disrespectful behavior among students, with uneven results" (Danielson 2a) is not a fair rubric. A rubric that rates a teacher ineffective because "students' body language indicates feelings of hurt, discomfort, or insecurity" (Danielson 2a) having nothing to do with how that particular teacher treats her particular students is not a fair rubric for teacher evaluations. Teachers do not just teach emotionally well-adjusted children from idyllic families and communities. We teach all kinds of children who live under various conditions. These conditions have a major impact on the emotional well-being of children.

Children experiencing emotional distress due to factors beyond their teachers' control quite often have trouble concentrating in class yet to be considered "highly effective" under Danielson, Virtually all students are intellectually engaged in the lesson." We teach children with selective mutism and other speech and language and learning disabilities yet Danielson doesn't take this into account. Students' emotions have an impact on their academics, and students' emotions are impacted by many factors beyond any teacher's control such as homelessness, marital stress in their home or divorce, loss of employment of a caregiver, physical or emotional abuse, mental illness, bullying outside of their classroom, personal illness or illness of a loved one and many other factors too numerous to list. Holding a teacher accountable for these factors that are beyond a teacher's control is not reasonable and yet that is what some of the components under Danielson demand.

Teachers in NY are frustrated and demoralized by a teacher evaluation system that has robbed us of our professionalism.

We demand an end to this absurdity. We demand that NYS change its education laws so teachers can return to the practice of seeing their students as human beings who are so much more than a test score or a robot that must adhere to absurd requirements under the Danielson Rubric in order for their teacher to be judged "effective" or "highly effective." NYS has created an adversarial relationship between students and their teachers and this absurdity must end now.

Teachers have no confidence in the evaluation system that reduces teacher worth into a meaningless series of numbers and letters. Teachers in NYC fear classroom observations are not being used to help them grow professionally, but instead teachers must teach to try to score points on Ms. Danielson's often misused framework.

In NYC, there is a climate of fear in the classroom which does not lead to improved teacher practice. Four observations per year for veteran teachers is excessive. One per year or every other year is sufficient for the vast majority of veteran teachers. Ms. Danielson stated in Education Week that after three years in the classroom, teachers become part of a "professional community" and should be treated as such.

Danielson says:
Personnel policies for the teachers not practicing below standard—approximately 94 percent of them—would have, at their core, a focus on professional development, replacing the emphasis on ratings with one on learning.

The $50,000 ATR Question

We've been offered $50,000 to go away and not be to heard from again.

As many know by now, there is a new ATR agreement bestowed upon the unsuspecting, the injured, the desperate, and the pissed done in secret by the powers that be of our wonderful union, the United Federation of Teachers (Yeah, I know I am a little late to the game in sharing).

To tell you the truth, I stopped and thought about it. That's a lot of money. Figure about $15k is taken off the top and that would leave me $35k. There is this deli or something on NY 203 in Spencertown (Columbia County) NY that used to be a general store. I have a small dream of buying this place when I retire and living up there full time. I could be another Sam Drucker. Sadly, I am 53, not eligible for a full pension until 2021 and my son graduates high school in 2019. So there goes that dream, for now.

But no one is going to take the offer unless they are thisclose to retirement or thisclose to being fed up. Want to delete the ATR pool? Offer early retirement. It's been done before.

But I have some question and/or concerns about the rest of the agreement.

Some of the highlights/lowlights:

After October 15, ATRs will be given a temporary provisional assignment to a school with a vacancy in their license area where available.

So what is it we do up until October 15? But even after October 15, here is a problem.

Say they put you provisionally in school after that date. You are a common branch teacher and you have been in the ATR pool since 2012. When do you think the last time a teacher in this situation had any true professional development? When was the last time such a teacher was trained on the latest and newest curricula? When was such a teacher trained in Danielson, or had any real meaningful feedback? 

Oh please, we will hear, "You are a teacher, that means you teach!" Well, I have a friend who is a doctor of proctology, I'm not going to see him about heart murmurs, am I? I mean, he is a DOCTOR? Using the DOE's logic he should be able to transfer is knowledge of colons and rectums to the heart.

But here is another problem. Instead of just plopping an ATR provisionally into any school, why not meet and/or interview the ATR and find out what their strengths are so they can be placed properly. Make it a win-win situation for all? How difficult can this be? 

The DOE, at its sole discretion, may choose not to assign an ATR to a temporary provisional assignment who have been penalized (as a result of a finding of guilt or by stipulation) in conjunction with §3020-a charges based on the circumstances of each case.

OK.

The DOE shall not be required to send more than one (1) ATR at a time to a school per vacancy for a temporary provisional assignment. These assignments will first be made within district and then within borough.

This is good and bad. It's good if your district is in Western Queens or Brooklyn and you live on Long Island, or the South Bronx like I do and live in the Hudson Valley. Put me in District 10 or 11. It'll chop 20-30 minutes off my commute.

But, if it all comes down to it I would much rather stay in District 7. I know the neighborhoods, I know the schools. I know the teachers. This year I have been lucky enough to know a few teachers in each school I have been at. It makes the transition easier. 

But it will affect more ATR's than it won't and this is not a fair.

It is understood that at any time after a temporary provisional assignment is made, a principal can request the removal of the ATR from this assignment and the ATR can be returned to the ATR pool and be subject to the terms and conditions of employment then applicable to ATRs pursuant to this Agreement.

This should be good. Don't like the school you are at show up wearing a dress or a pro Donald Trump shirt and boom! You go back in the pool.  

What this agreement does not mention though is for those who are still being rotated, how long will the rotations be? 

But there are other problems with this agreement, most of all the secrecy in which it was done and which James Eterno, Arthur Goldstein, Chaz, and Norm Scott  have written about.

When ATR's received the email concerning the new ATR there is a link that takes us to a online form if we have any questions (ATR's should have some fun with this form and inundate it with REAL COMMENTS, wink, wink, nudge, nudge) for the UFT.

What is perplexing is why after the genie has packed up and left the bottle is there a way to talk to the UFT about the agreement?  Why at no time did UFT leadership, re: Mulgrew and Barr take the time and play make believe and treat the ATR's as if we are retired members who live in Southeast Florida and come to us? Five borough UFT offices, five meet and greets, five question and answers, five separate days of at the very least pretending to give a shit what is on the minds of the ATR! If Mulgew was so afraid of meeting with ATR's get some tech geek to set up Survey Monkey and blast the poll out to ATR's.

I know James Eterno was working on getting ATR's recognized as a chapter and I have lost track of what the current status of that struggle is but is time to take a big step in my opinion. The fact that a few people are making the decision for about 2,000 teachers is beyond the pale and patently unethical. The ATR's should have a chapter, should have a seat(s) in the delegate assembly, and should have a seat on the executive board. The worst part is this agreement is rammed down our throats without even having a chance to vote on it!

The UFT is figuratively emasculating the ATR's by not being proactive to what we want and need. It is time that our leadership stops being reactive and try being proactive and hear what we want and need. All it will take is a little listening and a lot of empathy. How difficult can this be?

In the meantime something needs to be done. Can a complaint be filed with the National Labor Relations Board, NYS or US Department of Labor, or PERB?

Please don't tell me or any ATR that our Chapter Leaders in our schools are there for us. Many of them don't know who we are, don't care, too inexperienced, or bought. An ATR and the CL are two ships passing in the night.

Without Jia Lee Stronger Together is Weaker Apart (UPDATED 2/22/17)

UPDATED 2/22/17: The views expressed in this blog post are mine and mine alone. At no time did anyone from MORE or any other union member ask me nor attempt to coerce me into writing this blog post. 

One more thing. The kitten on the left represents ALL teacher union members across New York State.


The beginning of this month we shared on these pages that NYSUT VP Andy Palotta will be running for NYSUT president as the Unity candidate against  Michael Lillis, presidential candidate for the Stronger Together caucus.

Recently, both Arthur Goldstein on his NYC Educator Blog and James Eterno on ICEUFT Blog have both queried why ST does not have any UFT members on their slate.

Arthur writes;
"When I realized that Stronger Together was running four people against five, I saw an instant solution to my problem, which is that they have no UFT representation whatsoever. They could run Jia Lee, who bravely faced an uphill battle against Michael Mulgrew last year. They could run James Eterno, who got the majority of high school votes for High School Vice President, but who isn't VP because UFT Unity rigged elections....
And James;
"I'm not happy that ST didn't agree to support any of us UFT dissidents for NYSUT office, particularly since some of us joined ST when it formed back in 2014. Arthur Goldstein (Chapter Leader Francis Lewis High School in Queens) ran for Executive VP back then against Pallotta."
Now while I have the utmost of respect for both Arthur and James I have to agree with Arthur and truly believe that MORE UFT presidential candidate Jia Lee should have been on the slate for ST. Mind you that the ST slate only has four candidates whilst normally there are five.

Why is Jia not on the slate? 

Jia not only has a great reputation throughout NYC, but across the state and nationwide. Jia has testified before the United States Senate, has close ties with the anti-establishment locals, close relationships with New York State legislators, Badass Teachers, and just as importantly, received 20% of the vote in the 2016 UFT elections. No small feat when going against the entrenched machine of Unity. And let's not forget what Jia has brought to not only the Opt-Out Movement in NYC, but just about everywhere.

Yes, unseating and winning the NYSUT elections is a tall order for anyone not backed by Unity. The 2017 RA is on Unity's home turf at the Hilton in Manhattan and we all know how anyone associated with Unity will vote. But why not give those who are against Unity an outside chance?

There are some indisputable facts in the upcoming election that we must heed. NYC, Yonkers, Albany and Rochester will vote Unity. That's a given. On the other hand Buffalo, Long Island, and the North Country will and should be behind ST and even more so if Jia were a part of the slate. The Southern Tier will probably be split between Unity and ST, as well as the Hudson Valley. With Jia ST will without a doubt give Unity a run for it's money. Without Jia it'll be another Unity triumph for sure.

But let's say that ST does pull it off. Then what? Without NYC representation the doors will be slammed shut in Albany and Washington DC. There will be no clout. Nada. Bupkus.

MORE in the previous election lifted ST. Where is the reciprocity from ST? Arthur however brings up an interesting question in his blog post which bears a ponder;
"Could their (ST) negative relationship with a single MORE member have led them to stereotype us?" (Hmmmm, could this be someone who does not play and work well with others?)
Whatever the reason ST did not choose a UFT member, let alone Jia, not only it is ST's loss but more importantly, and much, much worse, but a major setback for the teachers and students of New York State.

UFT Solidarity Goes Blah, Blah, Blah

In case you missed it, The Chief, the civil service newspaper did a piece on the upcoming UFT elections entitled "Bid to Topple Mulgrew in Next UFT Election", written by Dan Rosenblum.

Dan focused on the two factions, or caucuses, that are attempting to unseat Unity; MORE/New Action and of course UFT Solidarity. For MORE/New Action Dan spoke with former UFT presidential candidate and MORE member James Eterno, currently an ATR social studies teacher, former chapter chair at Jamaica High School, elected to UFT exec board for ten years, and union delegate from Middle College High School (What a resume!), and the leader of UFT Solidarity. The priorities could not have been more striking and contradictory.

James takes a holistic approach to the travails that are facing teachers;
“Evaluations of Teachers based on student test scores has got to go,” Mr. Eterno said. “Not 20 percent, 40 percent, 50 percent or whatever percent; it should be zero percent.”
Bravo James. Think about it. James takes something, the evaluations, and knows that this beast needs to be toppled before everything else we want can to fall into place. Remove the onerous evaluation system and the vast majority of abuses against teachers will dissipate a great deal. This is thinking realistically, thinking of the greater good, and truly thinking like an adult.

Speaking of the back pay James goes on to say;
“Now the city has a $5.9- billion surplus; they certainly could have afforded to have given us the retro money from 2009 to ’11 now instead of making us wait,” he said. We’re optimistic that this is going to be an opposition slate that does better than we’ve seen in decades.”
Well thought out points. Not bad for someone who can't even be a chef in a 5 star restaurant.

On the other hand, we learn that UFT Solidarity team is  "still coming together" even as it nominates those with curious resumes, advocating those who claim they are lawyers, and makes one question whether or not 20 years later, that a nominee of theirs is officially a UFT member.

But again, UFT Solidarity shows it is a One Trick Pony in that it is seen as only an...
"...advocate for educators who feel they have been cast aside by the Department of Education, including those in the Absent Teacher Reserve and probationary Teachers who are dismissed by administrators before they are granted tenure."
Here is a observation. While we here at SBSB feel for the probationary teacher that has been unfairly terminated by the DOE, they sadly are not UFT members. We here at SBSB wish to know how many of these non-UFT members are in decision making roles of UFT Solidarity and if any are, should they be making decisions that can affect membership?

But the leader of UFT Solidarity shared a warning, formidable words for Mayor Bill de Blasio;
"Our thing is: go out there, speak to the Mayor, collaborate as much as possible, but if members’ rights are going to be attacked, if students are going to be neglected, then we’ll definitely increase the knob on activism,”
Well darn, that is the one of the few times we have heard of students coming from UFT Solidarity, but gosh darn, one can assume upon reading this that Mayor de Blasio crapped his pants from fear. 

The UFT Solidarity leader also pointed out that support comes from Facebook...
"comments that tell 'a different story' of a disconnect between the union’s leadership and its rank-and-file members."
Yes, but of course no disconnect comments between the the rank and file and UFT Solidarity are allowed. But again, we are talking about maybe between a dozen and two dozen that continually tithe UFT Solidarity with sycophancy.

The UFT Solidarity leader also said...

"...it was too early to quantify the slate’s support, but counted about 100 active members, a number that he said sounded low, but was high compared to other groups."
Just 100 active members? We stand corrected here at SBSB and wish to apologize for claiming that there were 66 active members of UFT Solidarity. With 100 members you know what this means? That there are 34 more to not show up at the mass rallies that UFT Solidarity sponsors, that UFT Solidarity has hit triple digits, and begs the question, how many of these 100 are current UFT members?

One interesting thing that was published in this article were some statistics. In 2010 Mulgrew received over 41,000 votes and in 2013 received nearly 36,000 votes. So it is save to assume that somewhere between 41k and 36k votes are needed.

Since the leader of UFT Solidarity has already proclaimed months ahead of time that UFT Solidarity will win the presidency of the union one would ask, where are these votes coming from?

James Eterno Cooks Up a Recipe

This past Sunday on the ICE Blog, James Eterno wrote a very well thought out and lucid piece on
what he sees for the UFT in 2016.

His crux for the piece, and as he says NYC Educator beat him to it, was how under the renewal schools teachers will be brought to the altar to be sacrificed. That the UFT is basically selling us out.

He talks of an alternate universe in which Mulgrew is ousted;
"...there is a real union leader as president, things would change in a hurry. Besides cleaning house by dismissing most of the loyalty oath signing Unity faithful and opening up union positions to senior, qualified people (like comp time) and having elections for the District Representatives, we would need to change the whole conversation around education as quickly as we can"
One can immediately notice that James did not prophesize that there is a grand mystical plan that he will be the next UFT president nor has he written as if he is entitles to that role. He sees the UFT as something larger than him that the word "I" need not be used.

James goes on to share what he has seen and what needs to be fixed throughout the system. Not once is he electioneering or tooting his own horn. He is laying out the facts as he sees them. Nothing more, nothing less. UFT Solidarity UFT Solidarity UFT Solidarity UFT Solidarity UFT Solidarity

In fact, I disagree with him with the so-called truth commission he advocates. Yeah, it would be nice for it to happen. In fact it should happen, but how to you compel people to come to testify? Will there be subpoena power? Will testimony be under oath? Will immunity be granted?

Truth should have been out by now. Three years ago on these pages I questioned where is the Daniel Ellsberg, the Pentagon Papers of the education world?

But wait a minute. The Crack Team just reminded me of something. How can it be that James writes such a vision when he is nothing more than a chef in a restaurant and not a real star like the owner of said restaurant?

To catch those who don't understand what is being said,  XXXXXXX XXXXXXXX has claimed that James Eterno is nothing more than a chef, probably a failed chef at that when what we need as a union is one who manages a 5 star restaurant. XXXXXXX XXXXXXXX believes that only such a manager can right the sinking ship of the UFT. But questions persist. 

First, which guide is this so called 5 star restaurant based on? Mobil? Michelin? Zagat? Yelp? TripAdvisor? Inquiring minds want to know.

But who goes to a restaurant because of the manager. No one. We here at SBSB can't think of one reality show that espouses to find the best manager of a restaurant. All the restaurant based reality TV shows are all looking for the best chef. Wouldn't it be better to have a Master Chef instead of someone who isn't even able to be Master of their Domain? 

In fact, we have spoken with one of New York's leading chef's and he has shared his expertise. He told The Crack Team that for a 5 star restaurant, the chef is the most important person, not the manager. 

Anybody can manage a restaurant. Last week driving back and forth through Pennsylvania and the Southern Tier of New York we came across many Arby's. I am sure that at each Arby's the managers were top notch. But no one even goes to Arby's because of who the manager is.

It is easy to manage a restaurant. You hire the people, you seat people, you pay people, but think about it, if your chef sucks ain't nobody coming back to your restaurant unless you have the seniors early bird special or you have the 2 for 1 coupon in the Entertainment book

Let's see what job is more difficult. The restaurant manager (Telling the waiter to push the malt wine) or the chef

The kitchen and the person who runs the kitchen are what makes a restaurant.

From our NYC leading chef groupie: In fine dining, without a clear vision of the food, and someone to maintain quality and consistency, the reputation sours quickly.

Also food and labor costs are the highest in the business, and the chef is fiscally responsible for controlling them.

People also tend to forgive bad service before bad food

IT'S OFFICIAL!!! SPARKLES THE CAT SEEKS UFT PRESIDENCY!!!

Several days ago, in what then was a tongue in cheek blog post, we here at SBSB suggested that my cat Sparkles, run for UFT president.

Apparently when we were all asleep Sparkles manages to read that post and sat down with me to discuss the possibility. She has spent the last several days contemplating a run and today decided to sit down with members of The Crack Team to announce her decision and share her policy points.

Here now is the entire "presser" held by Sparkles, with myself offering the translation from cat talk to English, completely unedited.

Sparkles, you called us to your home today telling us you have a major announcement. What is it?

I have decided to throw my hat in the ring and run for president of the UFT

Which caucus nominated you? In fact which caucus are you with?

Careful there bub. I have yet to be nominated. I find it presumptuous to nominate oneself or even influence others to nominate me.

As for which caucus I am aligned with, that would be the MORE caucus. You can say I represent teachers that are cat owners. 

And just what is it you have done for teachers that own cats? 

I have started the UFT Kitty Alliance FB page (Well I didn't start that someone else did), Don't Tread on Teacher Kitty Owners, I have been there for teachers when they need to talk to someone about their kitty coughing up hair balls, I have begun many websites and list servs as well.

And have you engaged in any picketing in favor of teachers that own cats? 

No. Basically it is a waste of time picketing a school with only 8 people and one of those 8 are wearing a Captain Picard uniform. Picketing is all well and good but basically, without community support, or the "real" media involved, you basically look like a bunch of schmucks out there.

It's better to establish a presence within the school to hand out information extolling the caucus, i.e. when are meetings, people to contact, etc... Also to reach out personally to other groups in the community. Picketing, unless you truly narrowly target where you are picketing, such as an unexpected place, makes you look like a bunch of schmucks. 

Now mind you, there are cat owning teachers that have been discontinued, brought up on 3020-a charges, are being harassed, but empty gestures can only raise their level of expectations which in the end will disappoint them.

So all these social media pages have they affected any change within the DOE or the UFT?

You're joking, right?

Why do you expect to be nominated?

I don't. If I do, fine, if I don't fine. Democracy rules. I can honestly tell you there are people more worthy than myself to be UFT president. My owner has listed them here.

Speaking of which, I feel blogs have more (Pardon the pun) influence and more reach, at least the popular ones, such as Ednotes, Chaz, NYC Educator, SBSB, Raging Horse, ICE, DOENUTS, than picketing and all that stuff. The above blogs are what the people read!

Some say that James Eterno will be nominated. What would you do if he is? Will you put up a fight?

I will graciously step aside and support James. Remember, anyone can own a restaurant not everyone can be a 5 star chef and it is the chef that brings in the people to the restaurant.

And on that note James once made me a liver, chicken and cheese påté that was to die for!

If James is not nominated and you are, would you offer James the position of UFT Secretary?

I don't know if James would accept that job. I would like to have James be my closest advisor, much as Clark Clifford had been to many presidents. Anyway I am thinking of having my good friend, Bill the Cat be secretary.

And if you are nominated, what can we expect?

You can expect to have someone there to work their butt off for every UFT member there is and I will put in place throughout the entire UFT only those that will put members first. I will not have an ego, I will allow anyone to come to me if they disagree with me and I will not be vindictive, I will not have a hissy fit, and I will be mature with those who are of independent thought.

Last question, what can the rank and file expect from a Sparkles presidency? 

It will be a union run buy the teachers, for the teachers. If I become president, God willing, I will stand before the rank and file a humbled kitty. That all egos will be checked at the door and that each member of the union is as important a cog in the wheel as me or anyone.

ATR in Queens Treated Like A Child

This is yet another story from the files of "You Can't Make This Sh** Up!" A continuing series of the most boneheaded moves from NYCDOE upper echelon.

Today's story is another in the long line of ATR abuse. The ATR (Absent Teacher Reserve) in question is of course a veteran teacher, The Crack Team believes she is over 40, and just wants to do her job. The story is in her words and comments are added by The Crack Team.

The story revolves around how this ATR was late twice by late than 30 minutes and the principal at the school had decided not to just deduct the time from her CAR but rather give her two unexcused absences with the subsequent 2 says of docked pay.

Principal says she has to call legal about my being late 2x payroll Secy put it in as unauthorized absence 29 minutes and says I'm being docked I called the school each time said I was stuck in a construction area on union tpke she not only didn't give me any transportation delay form to fill out she didn't even put it in my car as late instead put it in unauthorized because if you're under 30 minutes total lateness you're okay so I explained this to the principal who said she's calling legal for two lastenesses under 30 minutes and I called she said she wants phone records from me to prove it.......prove this.

 Hasn't there been quite a bit of construction on Union Tpke in Kew Gardens near the Van Wyck of late?

Why not give the transportation delay form? What's the big deal?  But phone records? Why not get the phone records of the school. Surely their bill has numbers of who is calling in. 

I told the principal I would look up my cell phone record..I asked them for the dates..I have one date and the call..the other one I"m not so sure..and I also never knew about a 'transportation delay form'..but if they want to go 'legal' go right ahead. Both latenesses were under 30 minutes.

 These people don't want anyone to know of the OP201 form.

Payroll secretary lambasted me in front of the staff in the office again..screaming..Everyday it's something else with you..I'm like..you really need to chill out..I"m asking you about my timekeeping..you put in 29 minutes as 'unauthorized' absence on my CAR..I showed her the print out..and it blew her feeble mind apart.

Yeah chill out! Here's the thing. The secretaries take on the personality of  the principals. Of course if you come to a school for 5 days you are not into the flow of things there and need to go to the one other person besides the custodian who knows what is happening in the school. 

But how is 29 minutes get you docked for the day??

 But why not got to the CL of the building? Some comments of the CL from time spent in the building.

union rep who I reported to the UFT office for telling me that I'm a 'guest' at his school and he 'doesn't have to represent me'

I had already been ranked out by the UFT chapter chair in the school earlier.

No wonder ATR's need their own chapter. ATR's, reach out to James Eterno for advice and assistance. He is an ATR, ran for delegate at the school he was assigned to and won! He is fighting for the ATR's to have their own functional chapter. He's a real mensch and it'll be good to talk to someone.
  
This stuff has got to stop. The union and it's leadership is enabling this crap.
